What are the correct terms to use in filing a formal complain?

July 29, 2010 // Posted in Law & Ethics (Tags: , , , ) |  1 Comment

A telecommunication company here in the Philippines offers an Unlimited Text (sms) service for prepaid account. For 150 pesos, you can have 30day unlimited text to the same network. For 2 consecutive times now, they removed my unlimited service without prior notice. The first time, I just consumed more or less 18days and the just this month; just 3 days after I loaded they removed it again.

When I called their hotline, they kept on saying that they blocked my unlimited service due to abnormal usage. The company keeps on advertising that their service is unlimited when in fact it is not! I was asking them what is their basis for “normal usage” so that I could watch over my usage but they won’t reveal it, they insist that it’s system generated. They won’t properly inform the consumers about it.

What are the things should I include in my formal complain? Should I put “false marketing” and abuse of my consumer rights since I haven’t got the full service I purchased?

What is Social Security law in Washington State if your suppose to receive part of a trust and want to opt out?

July 23, 2010 // Posted in Law & Ethics (Tags: , , ) |  2 Comments

Does anybody know what the Social Security law is in Washington State if your suppose to receive part of a trust and want to opt out?I have heard in some states you are not allowed to opt out of a trust and continue receiving S.S.I. Any help and links would be appreciated.

Does anyone know what kind of reasoning allows for federal employees to opt out of Social Security?

The practice seems unfair since I don’t have a choice. And the people that are regulating social security don’t have a stake in it.

It also would add money to SS coffers if the federal employees had to enroll.
I honestly didn’t know the reasoning. I think it probably was because they already had a good pension. However, it seems then that if you have a good pension, you too, should be able to opt out.

How has the law screwed you?

May 18, 2010 // Posted in Law & Ethics (Tags: , , , ) |  1 Comment

This is a very long post, but The main point of this is, please tell me about your bad experience with the justice system. I will soon start a website, devoted to the men and women who are sold out for a power trip, left out to dry, and just plain screwed. Please Let your story be heard. It has always been bad but this is the final straw here, as i am looking into putting up a table stand near the bike traiI, where i would play guitar, sell drinks and homemade jerkey, good times, with most(75%, I still gotta eat) of the profit going to a good honest charity(any ideas?). I may be almost tax exempt but i read multiple counts of children shut down or extorted of their lemonade money, fruit stand money, what have you, by the black hole we call the government. since when does a lemonade stand require a building permit, business license, health inspection, and financial records? One boy and his parents in the netherlands was put out over $1500.00 for his. is this really the point where we are at as a society? Six year olds break the law when they make a cheap, delicous drink, sitting on a milk crate, out in the heat, sweating bullets, all just to make a few dollars? lets not forget the fact that they are offering a product, that we as free Americans, decide to purchase. Who needs to dip their hands in the pockets of a SIX YEAR OLD girl? What next, fill out a w- for Grandma’s Christmas card? That Malibu barbi is now 36% more expensive. Add to that the 7% sales tax. Sorry, honey, maybe after Easter. now what these kids are doing seems to be the basis for free market systems that this country was founded upon. how would our forefathers react to this, tax money wasted on a six year old guilty of quenching thirst? IRS agents, health inspectors, and the police have all been called in to put pressure on fukcing LEMONADE STANDS. Two goons from the IRS probably make more in a day than this girl makes(or spends for that matter) on lemonade in ten years. It happens all the time; on all levels, our rights as human beings, and wild animals(albeit neudered) are stepped on. At the same time, football players and movie stars kill people, and get a slap on the wrist.I dream of an America where people actually care about each other, to the point where they would rally in the streets, fight and sacrifice, even GIVE their LIFE for a complete stranger(non-famous) at the slightest scent of injustice. It is something we would all benefit from. There are thousands of cases, every year; judges paid, jurors paid, jurors threatened, false/ planted evidence, no evidence, framing at the highest level, the list goes on and on.The waste, the greed, the corruption, and pure garbage must be rid of this country. WE as the public need to put a fear into our “leaders”, law enforcement, justice system. Like the kind of fear that keeps you up at night, cause you think you might not wake again. Let them know they are not untouchable, as they believe, and want you to believe. The newspapers should have an entire section dedicated to keeping the courts transparent, with details of all cases, written by a member of the real public, not some journalist getting bjs under the table by the same liars they are writing about. Put the judge’s address in there too. Free things don’t always stay that way. remember when water was free? WE need to do something quick before our country becomes a police state. Thank you very much. feel free to email me if you wanna talk about something interesting…..

Why are MMS blasts against FCC regulations?

May 13, 2010 // Posted in Law & Ethics (Tags: , , , ) |  1 Comment

Mobile marketing companies are allowed to send SMS blasts to people that have opted-in to their databases. However, I am under the impression that it is against FCC regulations to send MMS (video, pictures, audio) blasts to opted-in databases. Does anyone know why we can’t do MMS blasts?

Why would you opt for an ex parte rather than a restraining order?

May 1, 2010 // Posted in Law & Ethics (Tags: , , , ) |  3 Comments

I do some volunteer work with a victim’s rights center and we recently had a training over ex partes. I was wondering why a victim would choose an ex parte rather than a restraining order since an ex parte has no distance protection. I’m in Missouri so I don’t know if it varies from state to state. Any suggestions or answers would be great.

How Do I Opt Out of Michigan Friend of the Court Services?

How do I Opt Out of Michigan Friend of the Court Services in my Domestic Relations/Family Court Case?

Can a judge opt NOT to sentence someone to a mandatory minimum prison term?

April 4, 2010 // Posted in Law & Ethics (Tags: , , , ) |  3 Comments

The violation here is possession of a handgun for someone who is a prior convicted felon. The state is VA. Best of my knowledge, VA law prescribes a mandatory minimum of five years imprisonment. I am wanting to find out more information for a friend who is awaiting sentencing. He has already been found guilty for the gun possession. Aside from the gun possession and the prior felony, this is a descent man who I believe should not be in prison. Can anyone in the know shed any insight?

Is it legal to post pictures from an official movie website onto a blog?

February 17, 2010 // Posted in Law & Ethics (Tags: , , , ) |  1 Comment

I’m writing a story about the Dark Knight for a marketing agency’s blog and need to find out if I can use pictures directly from the Dark Knight website.

For my own site I wouldn’t care, but they are worried about legal issues.
